SECTION 1 — ACCEPTANCE OF TERMS
By accessing or using Kominote Lakay (kominotelakay.ca), you agree to be bound by these Terms of Use. If you do not agree, please do not use this platform. These terms apply to all visitors, registered users, business owners, and advertisers.
SECTION 2 — ABOUT KOMINOTE LAKAY
Kominote Lakay is an online directory operated by Philippe-Remy Enterprise Corp., based in Clarence-Rockland, Ontario, Canada. Our platform connects the Haitian diaspora with Haitian-owned businesses, services, community organizations, and resources. These terms govern your use of the website and any future features or services we introduce.
SECTION 3 — ELIGIBILITY
You must be at least 18 years old to create an account or submit a listing. By using Kominote Lakay, you confirm that the information you provide is accurate and that you have the authority to represent the business or organization you are listing.
SECTION 4 — LISTINGS
Free Listings Anyone may submit a free listing for a Haitian-owned business, service, organization, or community resource. By submitting a listing, you confirm that the business or organization is genuinely Haitian-owned or Haitian-led, and you accept responsibility for the accuracy of the information provided.
Premium Listings Premium listing features are available for a monthly fee as described on our pricing page. Premium subscriptions are billed monthly and can be cancelled at any time. Cancellations take effect at the end of the current billing period. No refunds are issued for partial months.
Listing Approval All listings are subject to review and approval by Kominote Lakay. We reserve the right to reject, remove, or modify any listing that does not meet our community standards, contains inaccurate information, or violates these terms.
Claiming a Listing If your business has been listed by someone other than yourself, you may submit a claim to take ownership of that listing. Claims are subject to verification.
SECTION 5 — ADVERTISING
Advertising placements, including Featured Listings, Sponsored Categories, and Top Listings, are available on a monthly subscription basis. Spots are limited per city and category. When a spot is unavailable, you may join a waitlist. Advertising fees are non-refundable once a placement has gone live. Kominote Lakay reserves the right to remove any advertising placement that violates our community standards or contains misleading content.
SECTION 6 — USER ACCOUNTS
To submit or manage a listing, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at hello@kominotelakay.ca if you suspect unauthorized access to your account.
SECTION 7 — REVIEWS
Users may submit reviews for listed businesses. By submitting a review, you confirm that it reflects your honest experience and does not contain false, defamatory, or misleading information. Kominote Lakay reserves the right to remove reviews that violate our community standards. Business owners may not submit reviews of their own businesses or solicit fake reviews.
SECTION 8 — PROHIBITED CONDUCT
When using Kominote Lakay, you agree not to:
- Submit false, misleading, or fraudulent listings or reviews
- List a business that is not Haitian-owned or Haitian-led
- Use the platform to harass, discriminate against, or harm any individual or group
- Attempt to gain unauthorized access to any part of the platform
- Use automated tools to scrape, copy, or reproduce content from the directory
- Violate any applicable Canadian federal or provincial law
SECTION 9 — INTELLECTUAL PROPERTY
All content on Kominote Lakay, including the platform design, logo, written content, and directory structure, is the property of Philippe-Remy Enterprise Corp. and is protected under Canadian copyright law. Business owners retain ownership of the content they submit, including photos, descriptions, and logos, but grant Kominote Lakay a non-exclusive licence to display that content on the platform.
SECTION 10 — PAYMENTS AND BILLING
Payments for premium listings and advertising placements are processed securely through our payment provider. By providing payment information, you authorize recurring monthly charges for your selected plan. You may cancel at any time through your account dashboard. Philippe-Remy Enterprise Corp. is not responsible for any fees charged by your bank or payment provider.
SECTION 11 — DISCLAIMER OF WARRANTIES
Kominote Lakay is provided on an “as is” basis. While we make every effort to maintain accurate and up-to-date information, we do not guarantee the completeness, accuracy, or reliability of any listing, review, or content on the platform. We are not responsible for the products, services, or conduct of any business listed in the directory.
SECTION 12 — LIMITATION OF LIABILITY
To the fullest extent permitted by Canadian law, Philippe-Remy Enterprise Corp. shall not be liable for any indirect, incidental, or consequential damages arising from your use of Kominote Lakay, including but not limited to loss of revenue, loss of data, or any harm resulting from reliance on directory listings.
SECTION 13 — GOVERNING LAW
These Terms of Use are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be resolved in the courts of Ontario.
SECTION 14 — CHANGES TO THESE TERMS
We may update these Terms of Use from time to time. When we do, we will update the effective date at the top of this page. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms. For significant changes, we will make reasonable efforts to notify registered users by email.
