These terms apply to all visitors, registered users, business owners, and advertisers.<\/p>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 2 \u2014 ABOUT KOMINOTE LAKAY<\/strong><\/p>\n<p>Kominote Lakay is an online directory operated by Philippe-Remy Enterprise Corp., based in Clarence-Rockland, Ontario, Canada. Our platform connects the Haitian diaspora with Haitian-owned businesses, services, community organizations, and resources. These terms govern your use of the website and any future features or services we introduce.<\/p>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 3 \u2014 ELIGIBILITY<\/strong><\/p>\n<p>You must be at least 18 years old to create an account or submit a listing. By using Kominote Lakay, you confirm that the information you provide is accurate and that you have the authority to represent the business or organization you are listing.<\/p>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 4 \u2014 LISTINGS<\/strong><\/p>\n<p><strong>Free Listings<\/strong> Anyone may submit a free listing for a Haitian-owned business, service, organization, or community resource. By submitting a listing, you confirm that the business or organization is genuinely Haitian-owned or Haitian-led, and you accept responsibility for the accuracy of the information provided.<\/p>\n<p><strong>Premium Listings<\/strong> Premium listing features are available for a monthly fee as described on our pricing page. Premium subscriptions are billed monthly and can be cancelled at any time. Cancellations take effect at the end of the current billing period. No refunds are issued for partial months.<\/p>\n<p><strong>Listing Approval<\/strong> All listings are subject to review and approval by Kominote Lakay. We reserve the right to reject, remove, or modify any listing that does not meet our community standards, contains inaccurate information, or violates these terms.<\/p>\n<p><strong>Claiming a Listing<\/strong> If your business has been listed by someone other than yourself, you may submit a claim to take ownership of that listing. Claims are subject to verification.<\/p>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 5 \u2014 ADVERTISING<\/strong><\/p>\n<p>Advertising placements, including Featured Listings, Sponsored Categories, and Top Listings, are available on a monthly subscription basis. Spots are limited per city and category. When a spot is unavailable, you may join a waitlist. Advertising fees are non-refundable once a placement has gone live. Kominote Lakay reserves the right to remove any advertising placement that violates our community standards or contains misleading content.<\/p>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 6 \u2014 USER ACCOUNTS<\/strong><\/p>\n<p>To submit or manage a listing, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at <a class=\" underline underline underline-offset-2 decoration-1 decoration-current\/40 hover:decoration-current focus:decoration-current\" href=\"mailto:hello@kominotelakay.ca\">hello@kominotelakay.ca<\/a> if you suspect unauthorized access to your account.<\/p>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 7 \u2014 REVIEWS<\/strong><\/p>\n<p>Users may submit reviews for listed businesses. By submitting a review, you confirm that it reflects your honest experience and does not contain false, defamatory, or misleading information. Kominote Lakay reserves the right to remove reviews that violate our community standards. Business owners may not submit reviews of their own businesses or solicit fake reviews.<\/p>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 8 \u2014 PROHIBITED CONDUCT<\/strong><\/p>\n<p>When using Kominote Lakay, you agree not to:<\/p>\n<ul class=\"[li_&amp;]:mb-0 [li_&amp;]:mt-1 [li_&amp;]:gap-1 [&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc flex flex-col gap-1 pl-8 mb-3\">\n<li class=\"whitespace-normal break-words pl-2\">Submit false, misleading, or fraudulent listings or reviews<\/li>\n<li class=\"whitespace-normal break-words pl-2\">List a business that is not Haitian-owned or Haitian-led<\/li>\n<li class=\"whitespace-normal break-words pl-2\">Use the platform to harass, discriminate against, or harm any individual or group<\/li>\n<li class=\"whitespace-normal break-words pl-2\">Attempt to gain unauthorized access to any part of the platform<\/li>\n<li class=\"whitespace-normal break-words pl-2\">Use automated tools to scrape, copy, or reproduce content from the directory<\/li>\n<li class=\"whitespace-normal break-words pl-2\">Violate any applicable Canadian federal or provincial law<\/li>\n<\/ul>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 9 \u2014 INTELLECTUAL PROPERTY<\/strong><\/p>\n<p>All content on Kominote Lakay, including the platform design, logo, written content, and directory structure, is the property of Philippe-Remy Enterprise Corp. and is protected under Canadian copyright law. Business owners retain ownership of the content they submit, including photos, descriptions, and logos, but grant Kominote Lakay a non-exclusive licence to display that content on the platform.<\/p>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 10 \u2014 PAYMENTS AND BILLING<\/strong><\/p>\n<p>Payments for premium listings and advertising placements are processed securely through our payment provider. By providing payment information, you authorize recurring monthly charges for your selected plan. You may cancel at any time through your account dashboard. Philippe-Remy Enterprise Corp. is not responsible for any fees charged by your bank or payment provider.<\/p>\n<hr class=\"border-border-200 border-t-0.5 my-3 mx-1.5\">\n<p><strong>SECTION 11 \u2014 DISCLAIMER OF WARRANTIES<\/strong><\/p>\n<p>Kominote Lakay is provided on an &#8220;as is&#8221; basis. While we make every effort to maintain accurate and up-to-date information, we do not guarantee the completeness, accuracy, or reliability of any listing, review, or content on the platform.
